TERMS & CONDITIONS
Effective date: [10th August 2026]
By using risingpsychiatry.com, you agree to these Terms. If you do not agree, please do not use the Site.
Purpose of the Site
The Site provides general information about Rising Psychiatry and the services we offer. It is an informational and administrative resource only.
No medical advice, no provider-patient relationship
Content on this Site is for general educational purposes and is not medical advice, diagnosis, or treatment. Viewing the Site, submitting a form, or communicating with us through the Site does not create a provider-patient relationship. That relationship begins only after a formal evaluation and a mutual agreement to begin care.
Never disregard professional medical advice or delay seeking it because of something you have read here. Do not stop or change any prescribed medication without speaking to your prescriber. Individual results vary and no outcome is guaranteed.
Regulatory status of treatments described on this Site
Transcranial magnetic stimulation (TMS). The TMS device used at Rising Psychiatry is FDA-cleared. The accelerated single-day protocol described on this Site is an off-label use of that device and has not been cleared or approved by the FDA. Off-label use is legal and is at the discretion of the treating clinician, based on published evidence and clinical judgement. Research into accelerated protocols is ongoing.
Cognitive applications. Any use of TMS for cognitive performance or cognitive impairment described on this Site is off-label and not FDA-cleared for that purpose.
If any claim on this Site is unclear to you, please ask us directly before making a treatment decision.
Emergencies
The Site is not monitored continuously and is not an emergency service. If you are experiencing a medical or mental health emergency, call 911. If you are in crisis or having thoughts of suicide, call or text 988 to reach the Suicide & Crisis Lifeline.
Accuracy
We make reasonable efforts to keep the Site accurate and current, but we make no warranty that content is complete, current, or error-free. Treatment protocols, pricing, and availability may change without notice.
Intellectual property
All content on the Site — text, images, logos, graphics, and design — is owned by Rising Psychiatry or its licensors and may not be reproduced, distributed, or used without written permission.
Third-party links
The Site links to third-party services, including our patient portal and payment provider. We do not control and are not responsible for the content, security, or privacy practices of those sites.
Limitation of liability
To the fullest extent permitted by law, Rising Psychiatry is not liable for any direct, indirect, incidental, or consequential damages arising from your use of, or inability to use, the Site.
Governing law
These Terms are governed by the laws of the State of Colorado, without regard to conflict-of-law principles.
Changes
We may revise these Terms at any time. Continued use of the Site constitutes acceptance of the revised Terms.
